Vocational Qualification Training

The Communiqué on the Vocational Training of Workers to be Employed in Heavy and Dangerous Jobs was published in the Official Gazette dated May 31, 2009 and numbered 27244. It is obligatory for workers to be employed in heavy and dangerous jobs to undergo vocational training before being hired.

Mandatory Vocational and Technical Trainings

In accordance with the communiqué on the Vocational Training of Workers to be Employed in Heavy and Dangerous Jobs and published in the Official Gazette dated May 31, 2009 and numbered 27244, all businesses in the dangerous, very dangerous class are required to have their employees receive Compulsory Vocational and Technical training. According to the legal regulation, young workers and children who have not completed the age of sixteen and workers who have not received vocational training related to their work cannot be employed in heavy and dangerous works.

Vocational Competence Training of Persons to be Employed in Dangerous and Very Dangerous Jobs

Legal basis: Occupational health and safety law numbered 6331, Article 17, Clause 3, (3) Persons who cannot document that they have received vocational training related to the job they will do cannot be employed in jobs classified as dangerous and very dangerous, which require vocational training.

In this context, heavy penalties await businesses that do not receive the relevant training. According to the regulation, a monthly fine of 1120 TL is imposed for each employee who does not receive and document the relevant trainings.

Certification of Vocational Education

Workers to be employed in heavy and dangerous works must have one of the following documents:

a) One of the diplomas, graduation certificates, authorization certificates, certificates, independent business opening certificates, journeyman, mastership and master trainer certificates given in accordance with the law numbered 3308,
b) Article 48 of the Unemployment Insurance Law No. 4447 and Article 4 (f) of the “Turkish Employment Agency Labor Compliance Services Regulation” published in the Official Gazette dated 31/12/2008 and numbered 27097 (6. Repeated). Course completion certificate obtained from the courses operating in accordance with the clause 23 of the same regulation,
c) Course completion certificate, operator's license and driver's license obtained from courses operating in accordance with subparagraphs (g) and (i) of Article 2 of the Private Education Institutions Law No. 5580,
ç) The igniter qualification certificate obtained within the scope of the Regulation on Determination of the Principles and Procedures for Granting Explosive Substance Igniter Competence Certificate published in the Official Gazette dated 11/7/2002 and numbered 24812,

d) Documents issued as a result of training activities organized by public institutions and organizations, professional organizations in the nature of public institutions, foundations and associations operating for educational purposes, workers' and employers' organizations, or employers with the approval of the Ministry of National Education, apart from the ones listed above. ,
e) Documents received from international institutions and organizations and whose equivalence is provided by the Ministry of National Education.
Employers are obliged to keep a copy of the vocational training certificates of the workers working in heavy and dangerous jobs in the personnel file prepared in accordance with Article 75 of the Law No. 4857 and show it to the authorized officers when requested.

Supervision of Vocational Education Mandatory

The issue of whether the workers who will be employed in heavy and dangerous jobs have compulsory vocational education diplomas, certificates or documents are inspected by the ministry's labor inspectors in accordance with the law numbered 4857.

Employers were obliged to keep a copy of the vocational training documents of the workers working in heavy and dangerous jobs in the personnel file prepared in accordance with Article 75 of the Law No. 4857 and show it to the authorized officers when requested.
